These general conditions of use (hereinafter the “General Conditions of Use”) set out the terms and conditions in accordance with which any Internet user (hereinafter the “User”) agrees to use the services and information available on www.sogitec.com as well as on any other web pages associated with this domain name (hereinafter individually or collectively referred to as the “Website”).

2.    User Acceptance of the General Conditions of Use

By accessing the Website and browsing the associated web pages, the User agrees to comply with, and be bound by, these General Conditions of Use. SOGITEC INDUSTRIES may be required to update these General Conditions of Use. In this case, the updated version of the General Conditions of Use will apply automatically to the User following the date of publication on the Website.

When a User wants to use a service offered by SOGITEC INDUSTRIES through the Website (e.g. mailing list subscription, contact form), the User must fill in a subscription form beforehand to be able to access or be entitled to it (hereinafter the “Dedicated Services”). Validating the subscription form entails the User’s full and entire acceptance of these General Conditions of Use.

3.    Dedicated Services 

SOGITEC INDUSTRIES reserves the right, at its sole discretion, to temporarily or definitively disable all access to Dedicated Services, at any time and without notice, for any reason whatsoever, including if the User has complied with the provisions of these General Conditions of Use. 

4.    Information and Content

The information available on the Website, including that related to the Dedicated Services, is provided by SOGITEC INDUSTRIES “as is” and without any guarantee of any kind whatsoever, express or implicit, including, without this list being exhaustive, any warranty of merchantability, fitness for any purpose, accuracy, precision, completeness, consistency or lack of inaccuracies, errors including misprints. 

SOGITEC INDUSTRIES reserves the right to modify Website information and content, including the Dedicated Services, at any time and without prior notice. SOGITEC INDUSTRIES shall not be held liable for the consequences of such modifications. 

5.    Availability

SOGITEC INDUSTRIES does not guarantee the User that access to the Website, including to the Dedicated Services, will be uninterrupted and free from viruses or any other harmful elements. SOGITEC INDUSTRIES may, at any time, without prior notice and at its sole discretion, suspend or cancel the User’s access to all or part of the Website or its features, including those of the Dedicated Services.

6.    Intellectual Property

All Website content, including the Dedicated Services (structure, text, documents, elements, graphics, software, etc.), is the exclusive property of SOGITEC INDUSTRIES or that of its service providers or is subject to an authorization for use and is protected under French legislation, particularly in relation to intellectual property rights. The logos, distinctive signs of SOGITEC INDUSTRIES, and any derivative versions thereof are protected by trademark law.

Any reproduction, modification, downloading, alteration, transmission, or dissemination, in whole or in part, of a document or information contained on the Website, including the Dedicated Services, is strictly prohibited without the prior written authorization of SOGITEC INDUSTRIES, with the exception of a copy for private non-commercial use, subject to compliance with intellectual property rights and with any other property right mentioned.

Any assignment or licensing relating to one or more Website elements, including the Dedicated Services, shall be subject to the prior written authorization of SOGITEC INDUSTRIES. Furthermore, any User who fails to comply with this clause agrees to warrant SOGITEC INDUSTRIES and therefore undertakes to defend, indemnify and hold SOGITEC INDUSTRIES harmless against all the consequences associated with any action and/or expenses incurred by or against SOGITEC INDUSTRIES following use of the Website, including the Dedicated Services, in violation of these General Conditions of Use or in the event of a violation of third-party rights including intellectual property rights.

SOGITEC INDUSTRIES shall not be liable to any User or any other third party for any direct or indirect damages or harm regardless of the cause, nature, or consequences, including, but not limited to, loss of income or revenue, loss of business, loss of profits, financial loss, loss of contracts or opportunities, loss of data or programs, loss of use or loss of savings, virus infections, loss of use of computer equipment for the User. 

9.    Applicable Law

These General Conditions of Use are governed by, and construed in accordance with, French law, excluding conflict-of-law rules.

10.    Attribution of Jurisdiction

In the event of a dispute concerning the execution, existence, termination, validity or interpretation of these General Conditions of Use, SOGITEC INDUSTRIES and the User will attempt to amicably resolve any dispute relating to the General Conditions of Use within a period not exceeding sixty (60) days following receipt of the first written notification of the dispute from the first party to take action to the other party. Any dispute that SOGITEC INDUSTRIES and the User have not resolved amicably under the preceding conditions shall be finally and exclusively settled by the relevant courts in NANTERRE (FRANCE) to which exclusive jurisdiction is attributed, even in the event of multiple defendants or call in guarantee. 

11.    Protection of Personal Data – Cookies and Other Trackers

The protection of your personal data is of great importance to SOGITEC INDUSTRIES.
 
SOGITEC INDUSTRIES undertakes to comply with all applicable provisions under the European (EU) Regulation 2016/679 of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and the free movement of such data (the “GDPR”) and the French statute of January 6, 1978 as amended (hereinafter collectively referred to as the “Personal Data Legislation”).

Any processing of personal data, as defined by the Personal Data Legislation, relating to a User and any use of cookies on the Website by SOGITEC INDUSTRIES are detailed in the “Protection of Personal Data Policy” hereinafter.

When an Internet user (hereinafter the “User”) visits the website as well as any other web page associated with this domain name (hereinafter individually or collectively referred to as the “Website”), SOGITEC INDUSTRIES may be required to collect and process the User’s personal data (hereinafter “Personal Data”) as defined by the European (EU) Regulation 2016/679 of April 27, 2016 relating to the protection of individuals with regard to the processing of personal data and the free circulation of such data (the “GDPR”) and the French statute of January 6, 1978, amended, relating to data protection and privacy (hereinafter collectively referred to as the “Personal Data Legislation”).

I.    Identity and contact details of the controller

The User may access certain services available on the Website. Some services may only be accessible if the User completes a form in order to benefit from them (the “Dedicated services”). Processing of Personal Data of the User who will benefit from such services is described in Section IV of this document.

SOGITEC INDUSTRIES may also be required to use cookies on the Website. The use of cookies by SOGITEC INDUSTRIES shall be in accordance with Section 5 of this document.

II.    Confidentiality

SOGITEC INDUSTRIES undertakes to process the User’s Personal Data with care and diligence, confidentially and in accordance with the Personal Data Legislation.
 
The User’s Personal Data is processed exclusively by SOGITEC INDUSTRIES personnel with a strict "need to know" in order to fulfill their duties related to the services available on the Website and provided by SOGITEC INDUSTRIES.

SOGITEC INDUSTRIES undertakes not to, either directly or indirectly, in whole or in part, disclose Personal Data to a third party or reproduce or have reproduced Personal Data, without the prior written consent of the User.

Notwithstanding the above, SOGITEC INDUSTRIES may, in some cases, pass on such data to its suppliers, subcontractors and partners, on a strict "need to know" basis for the personnel to fulfill their duties related to the services available on the Website and provided by SOGITEC INDUSTRIES.

SOGITEC INDUSTRIES implements security measures in order to prevent any unauthorized access and any disclosure, modification or destruction of Personal Data.
 
For this purpose, SOGITEC INDUSTRIES ensures the security of Personal Data by implementing physical and logical tools such as: 
•    SSL encryption (Secure Sockets Layer) when collecting and processing data. This security measure is guaranteed by the presence of an unbroken key or closed padlock symbol (depending on your browser).
•    Implementation of secure authentication procedures.
•    Implementation of secure architecture using recommended systems (such as antivirus, firewall, etc.).
•    Access control safeguarding the data confidentiality provisions.
•    Raising awareness among personnel about cybersecurity.
•    Physical protection for facilities hosting Personal Data.

Additionally, SOGITEC INDUSTRIES requires that its suppliers, subcontractors and partners implement technical and organizational security measures, in accordance with the Personal Data Legislation, in order to protect the Personal Data from any potential breach.

IV.    Collecting and processing Personal Data

The User may, via the Website, subscribe to the SOGITEC INDUSTRIES mailing list, but may also make a contact request directly to SOGITEC INDUSTRIES. 

As such, to be able to process such requests, SOGITEC INDUSTRIES must collect and process the User’s Personal Data through a form completed by the User.

1.    Mailing list service subscription

1.1    Legal basis

Collection of the User’s Personal Data through the SOGITEC INDUSTRIES mailing list subscription form is based on the User’s consent.
 
The request for consent is presented in an understandable and easily accessible form, and formulated in clear and simple terms. SOGITEC INDUSTRIES is able to demonstrate that the User has consented to their Personal Data being processed.
 
The identity of the controller, the purposes, the types of data collected and the existence of the right to withdraw consent are specified in the request for consent. It is as simple for the User to withdraw as it is for them to give their consent.

SOGITEC INDUSTRIES informs the User that entering Personal Data through the mailing list service subscription form is required for SOGITEC INDUSTRIES to be able to send the mailings to the User. The User is free to refuse to enter their Personal Data, accepting that the mailings cannot be sent to them without their consent.

1.2 Purpose

The purpose of processing the User’s Personal Data with regard to the mailing list service is to enable such mailings to be sent to each User who has subscribed to SOGITEC INDUSTRIES’ mailing list service. 

1.3 Retention period 

SOGITEC INDUSTRIES processes the User’s Personal Data for the duration of the mailing list service. 

The User is free to withdraw their consent by unsubscribing from the mailing list service at any time. The User’s Personal Data will be deleted and destroyed as soon as possible following the User’s unsubscription. 

1.4 Recipients 

The recipients of the Personal Data collected through the mailing list subscription form are the personnel and subcontractors of SOGITEC INDUSTRIES with a strict "need to know" in order to fulfill their duties related to the mailing list service. 

The User’s Personal Data is not transferred outside of the European Economic Area. 

2.    Contact request

2.1 Legal basis

Collection of the User’s Personal Data through the contact form is based on the User’s consent.
 
The request for consent is presented in an understandable and easily accessible form, and formulated in clear and simple terms. SOGITEC INDUSTRIES is able to demonstrate that the User has consented to their Personal Data being processed.
 
The identity of the controller, the purposes, the types of data collected and the existence of the right to withdraw consent are specified in the request for consent. It is as simple for the User to withdraw as it is for them to give their consent.

SOGITEC INDUSTRIES informs the User that entering Personal Data through the contact form is required for SOGITEC INDUSTRIES to be able to process their request and/or contact them. The User is free to refuse to enter their Personal Data, accepting that they will not be able to benefit from this service. 

2.2 Purpose

The purpose of processing the User’s Personal Data with regard to the contact request is to enable SOGITEC INDUSTRIES to process the request and/or contact each User who has filled out a request form to this effect. 

2.3 Retention period 

Information collected from the contact form is recorded and stored for a period of one (1) year. The User’s Personal Data will be automatically deleted and destroyed following this period.
 
The User is free to withdraw their consent at any time by contacting SOGITEC INDUSTRIES directly at the following address: contact-communication@sogitec.fr. The User’s Personal Data will be deleted and destroyed as soon as possible following the withdrawal of consent.

2.4 Recipients 

The recipients of the Personal Data collected through the contact form are the personnel and subcontractors of SOGITEC INDUSTRIES with a strict "need to know" in order to fulfill their duties related to this service. 

The User’s Personal Data is not transferred outside of the European Economic Area.

When the User browses the Website, data including Personal Data may be collected through cookies.

COOKIES POLICY

When an Internet user (hereinafter the “User”) visits the website as well as any other web pages associated with this domain name (hereinafter individually or collectively referred to as the “Website”), SOGITEC INDUSTRIES and its partners may use cookies - which process the User’s data including Personal Data - in order to improve browsing.

The cookies used on the Website by SOGITEC INDUSTRIES are described in section 4 of this document. The cookies used on the Website by partners are described in section 5 of this document.  

1.    Definition

4.2.1    Consent

For the cookies for which the legal basis is shown in section 4.1 as being "Consent," SOGITEC INDUSTRIES enables the User to consent to their use through a clear and positive action.

Using the "accept all" or "reject all" buttons appearing in the information banner, the User may consent or not in a comprehensive way to the cookies relating to the purposes shown. As such, through the information banner, SOGITEC INDUSTRIES uses an interface for collecting choices that is easy for the User to understand.

4.2.2. Configuration

Additionally, through a "configuration" window, SOGITEC INDUSTRIES enables the User to give their consent independently and specifically for each purpose associated with a cookie family (non-separable). As such, SOGITEC INDUSTRIES uses an interface for collecting choices that is easy for the User to understand.

4.2.3. Recording

The choice expressed by the User, whether it be consent or refusal, will be recorded by SOGITEC INDUSTRIES so as not to request it again for a period of thirteen (13) months (except in the event of changing device or deleting cookies).

Like many other companies and to secure the forms available on the Website, SOGITEC INDUSTRIES deploys GOOGLE’s "reCaptcha" tool on the Website.

Through the "reCaptcha" tool, GOOGLE makes direct use of four cookies that may collect the User’s data.

With regard to these cookies, GOOGLE is considered as the sole Controller as defined by the Personal Data Legislation.

6.    Personal Data Legislation

In all circumstances, the User reserves the right to access their Personal Data. The User may also request that their Personal Data is modified or deleted. The User may also object to their Personal Data being processed or request that this is restricted. 

For any requests or complaints, the User may send an email to contact-communication@sogitec.fr. The User may also contact the manager by addressing a letter to SOGITEC INDUSTRIES, Marketing and Sales Department, Communications, 4, rue Marcel-Monge, 92158 SURESNES CEDEX, FRANCE.  

The User also has the right to lodge a complaint with the supervisory authority, namely the French Data Protection Authority (Commission Nationale de l’Informatique et des Libertés, “CNIL”).
